How did the matter reach the SC?
The matter came to the Supreme Court through the petition of a 25-year-old woman. This woman had sought permission to abort the 23-week pregnancy. The woman said that she got pregnant with mutual consent but she does not want to give birth to the child because her partner has refused to marry. But the Delhi High Court had dismissed the petition on July 16 this year, saying that the petitioner was unmarried and she had become pregnant with her consent. It does not come under any provision under the Medical Termination of Pregnancy Rules, 2003. After this the girl approached the Supreme Court for relief. In an interim order given on July 21, the Supreme Court allowed abortion, giving relief to the woman, but continued hearing on the aspects related to the interpretation of this law. Marital rape victim can also get abortion
In this decision, the Supreme Court has given an important ruling. The court has made it clear that if a married woman becomes pregnant due to a relationship made without consent, then it will also be treated as rape under the Medical Termination of Pregnancy Act. That is, in this sense, he will also have the right to have an abortion.
